Standard Terms and Conditions of Business

1 Scope

1.1 These standard terms and conditions apply to the use of website, use of service, and to the purchase of contracts concluded through the website of weblock.io and all sub-domains (“Website”) or through related e-mail, personal or phone communication, and to all related services provided by Dietrich Rordorf Publishing Services, Hellring 9, CH-4125 Riehen, Switzerland (“DRPS”) or its succeeding rights holder.

1.2 Any user of the Website shall be referred to as “User”, and any user buying services from the Website shall be referred to as “Customer” throughout these terms and conditions.

1.3 Any business terms by the Customer which diverge from these terms and conditions shall not apply, unless expressly confirmed by DRPS in written form.

2 Website Terms of Use

2.1 Extent of the Website Terms of Use

General Use of the Website are subject to the following Terms of Use. By browsing, linking to, or making any other use of the Website you agree to these terms and conditions, which form a binding contract between DRPS and you as the user (hereinafter referred to as “User”).

2.2 Copyright of the Website and Website Content

Apart from archived website content, the website, website content and website design are the property of DRPS. The copyright belongs to DRPS or its licensors. The reproduction, redistribution, or collection of material from this website is prohibited. Permission to reproduce or redistribute parts of the website may be obtained by the user in written form from DRPS.

2.3 Website Access Restriction

DRPS reserves the right to block or to terminate the User’s access to the website at any time and without prior notice.

2.4 Linking to the Website

The User may link to the website or to the content on the website provided that the linking does not imply any endorsement of any kind of DRPS. DRPS reserves the right to force the User to remove any link pointing to this website.

2.5 Advertising

The website may contain advertising. DRPS does not endorse any responsibility of any kind for the content of the advertisement or sponsorship or the advertised product or service, which is the responsibility of the advertiser or sponsor, unless the advertised product or service is offered by DRPS.

2.6 Disclaimer of Warranty

THERE IS NO WARRANTY FOR THE WEBSITE AND ITS CONTENT, TO THE EXTENT PERMITTED BY APPLICABLE LAW. 2.7 Limitation of Liability

IN NO EVENT UNLESS REQUIRED BY APPLICABLE LAW SHALL DRPS, ITS EMPLOYEES, AGENTS, SUPPLIERS, CONTRACTORS OR ANY OTHER PARTY, BE LIABLE TO THE USER FOR ANY DAMAGES OF ANY NATURE, INCLUDING ANY GENERAL, SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES, LOSS, COST, CLAIM OR ANY EXPENSE OF ANY KIND ARISING OUT OF THE USE, INABILITY TO USE, OR IN CONNECTION WITH THE USE OF THE WEBISTE, ITS CONTENT AND INFORMATION, EVEN IF THE USER HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

3 Offering of DRPS

3.1 DRPS offers website caching services via the Website to natural and legal persons worldwide, which can be ordered by the Customer from DRPS through the Website, or by e-mail, phone or personal communication with DRPS.

3.2 DRPS offers a free plan to individuals for non-commercial use of the service. The free plan is limited in scope and functionality, does not incur costs to the Customer, and can be used with or without a user account with the Website

3.3 DRPS offers a paid, professional plan with additional functionality to individuals or organizations that wish to use the service on a larger or commercial scale.

4 Ordering and Purchasing of Services from DRPS

4.1 To order and contract a professional plan for the service through the Website, the Customer must first register with the Website.

4.2 The requirement for registering with the Website is that the Customer is of full age and has full legal capacity.

4.3 DRPS accepts the contractual relationship only by and once confirming the Customer's user account by granting access to the professional plan's application programming interface (API).

4.4 When purchasing services from DRPS, the Customer has the following cancellation right:

CANCELLATION POLICY.

Cancellation right: The Customer can revoke his user account and cancel the declared intention to conclude the contract for a professional plan any time during the first thirty days. For cancellations during the first thirty days, any benefits or interests received by the Customer up to the cancellation have to be returned to DRPS, or alternatively paid for. Thereafter, the Customer can revoke his professional plan user account only to the end of a month with a thirty days notice period, while any benefits or interests received by the Customer up to the end of the cancellation period have to be paid for.

4.5 When offering services to the Customer, DRPS has the following cancellation right:

Cancellation right: DRPS may turn down or reject the professional plan user account any time without specifying any reason and thus cancel the conclusion of the contract during the first thirty days. Thereafter, DRPS can cancel the Customer's professional plan user account only to the end of a month with a thirty days notice period. DRPS is bound to keep all archived website snapshots that have been archived by the Customer through the paid service level and paid for by the Customer forever.

4.6 DRPS explicitly reserves the right to suspend public access to archived website snapshots if prompted to do so by the legitimate copyright holder of the original website. In such cases, DRPS will not refund fees that were charged to the Customer as the snapshots continue to remain in our non-public dark archive.

5 Prices, Terms of Payment

5.1 Current prices are stated on https://weblock.io/pricing.

5.2 The Customer will be invoiced by e-mail and charged to on the Credit Card at the beginning of each month for the paid service level usage of the previous month.

5.3 Alternative payment arrangements have to be concluded between the Customer and DRPS in written form.

6 Contract Document

DRPS makes no provision for a separate contract document based on these terms and conditions. However, the Customer may check at any time the current service usage and accrued costs under the professional plan through his user account on the Website.

7 Changes to the Terms and Conditions of Use

DRPS reserves the right to change the present “Standard Terms and Conditions of Business” and “Terms of Use” at any time by posting changes to this page of the Website. The Customer will be notified by e-mail about changes affecting his contractual relationship with DRPS, and will be considered to have accepted such changes in case the Customer should continue the use of the website and service after DRPS has published changes to this page of the website.

8 Miscellaneous

8.1 Basel, Switzerland shall be the place of jurisdiction for all legal disputes arising of these terms and conditions, even if the Customer has its domicile outside of Switzerland.

8.2 Swiss law applicable at the place of jurisdiction of DRPS shall apply exclusively.

8.3 If any provision of the terms and condition should be found invalid, this shall not affect the validity of the remaining provisions. In any such case, the contracting parties shall negotiate on the invalid clause to substitute by a valid arrangement as close as possible to the original provision.
